In this agreement, this is what we mean by...

“We”, “Us” and “Our” refers to the company Hugo Mumbles

“You” refers to any visitor to the Site and therefore Our Customer

“Site” refers to our presence on the world-wide web, currently accessible via the address www.hugomumbles.com

“Content” refers to information in any form published on our site by us or any third party with our consent

“Terms” refers to these Terms & Conditions

“Carrier” refers to any person or business contracted by us to carry artwork from us to you

How to Order...

Ordering online with Hugo Mumbles is safe and secure. We do not store your personal financial information on this Site.

In order to create a contract between you and us, please follow the simple steps taking you through the process of placing an order. To place an order for the selected artwork simply add the art to your trolley and select ‘Checkout’. New customers will be required to register with the Site. Follow the steps to confirm delivery address and payment details. In doing this you offer to buy the goods at the prices indicated as well as the relevant delivery charges.

Before ordering please ensure that there is adequate room to fit the artwork into its proposed place. Measurements are stated within the artwork descriptions. You also need to provide us with up to date information about yourself so that we can arrange efficient delivery of your purchase.

We will send an automated order acknowledgment email to you listing the artwork you have ordered together with an anticipated despatch date. Please note that this email is merely an acknowledgement of your order and not an acceptance or confirmation of your order by Hugo Mumbles.

The acceptance of your order and the completion of the contract between you and us will take place when your order is ready for despatch, unless we have notified you that we have not accepted your order or you have cancelled it. Once we have accepted your order it becomes a binding contract, subject to your rights of cancellation. Non-acceptance of an order by us will occur in circumstances whereby we identify a pricing or artwork description error; the ordered artwork is unavailable; you are based outside our delivery area; or if we are unable to obtain authorisation for your payment. We reserve the right to cancel your order without liability. In such circumstances we shall let you know as soon as possible.

Your credit/debit card will be authorised when your order is placed and processed but you will not be charged for the value of the goods until the point of despatch. This does not affect your statutory rights.

We reserve the right to withdraw any artwork from the site at any time and/or remove or edit any materials or content, therefore, prices and availability of goods are subject to change without notice.

Please note that your contract is with us, not the artists that we represent. You may not under any circumstances correspond with or communicate with our artists regarding sales of artwork, returns, commissions or refunds.

Pricing and Payment…

The price of the artwork is displayed on our Site and stated in British Pounds Sterling (£GBP). This price does not include insured postage or packaging. There will be an additional charge made relative to the size and amount of artwork insured for postage and packaging. This charge will be clearly shown during the ordering process and is payable by you. You must pay us the full price of your order before we will send any part of it.

Payment is handled safely and securely through PayPal. Most major credit and debit cards are accepted.

When you make payment, under these Terms you confirm and undertake that the information contained within your order is true and accurate and that you are duly authorised to use the credit or debit card. Furthermore you authorise us to deduct from the credit/debit card the full price of the artwork and all other payments which may become due to us under our contract.

Price and availability information is subject to change without notice. Any changes will take effect from the day of publishing on this Site. You agree that we have no obligation to inform you of these changes and that it is your responsibility to establish whether the terms and conditions have been changed. If you disagree with any changes then you must stop using this Site.

Delivery…

Rest assured that your artwork will be packaged securely and safely. Deliveries will be made by the Carrier to the address stipulated in your order. You must ensure that someone is present to accept delivery and/or provide precise instruction on where you would like the artwork to be left if you are out when we deliver. Your delivery will require a signature on receipt.

Whilst every effort will be made to ensure that any artwork ordered is delivered within the period specified for delivery, any dates quoted for delivery of the artwork are approximate only and we shall not be liable for any delay in delivery of the artwork however caused. Artwork may be delivered by us in advance of the estimated delivery date. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

If we are not able to deliver your artwork within 30 days of the date of your order, we shall notify you by e-mail to arrange another date for delivery. You will be entitled to either arrange a revised date or cancel the order and receive a full refund. If we are able to make delivery in advance of the given date we will contact you.

We will require full and cleared funds payment prior to delivery.

Once the artwork has been delivered in accordance with your delivery instructions, you will be responsible for it. Our responsibility for everything other than damage due to our negligence or due to a manufacturing design or design fault will cease upon delivery. If you delay a delivery our responsibility for everything other than damage due to our negligence will end on the date we agree to deliver them.

When you receive your artwork, please check the piece(s) immediately.

We may deliver the artwork in instalments (on mutually agreed dates) if all pieces are not available at the same time for delivery. Each delivery shall constitute a separate contract and any failure by us to deliver any one or more of the instalments in accordance with these conditions, or any claim by you in respect of any one or more instalments will not entitle you to treat the contract as a whole as repudiated.

If we fail for any reason within our control to fully/partially deliver your artwork any reimbursement shall be no more than the price of the artwork, together with any delivery and/or reasonable return costs.

Both we and you are entitled to cancel the contract in respect of non-performance of obligations in relation to delivery. If cancelled we will refund you any monies already paid by you and any reasonable return costs incurred by you.

Returns...

If you are in any way unhappy with the artwork purchased you may send the piece(s) back for a replacement or full refund. You must notify us in writing within 14 days of receipt of your order.

To arrange a return, or if the artwork received is faulty or is not what you originally ordered, please e-mail care@hugomumbles.com quoting your name and address, details of the artwork, the reason for return and whether you require a replacement.

If you plan to return the artwork you must do this within 14 days of receipt of your order, sending the piece(s) to:

You must return the artwork in perfect condition, unused, with all packaging intact. The artwork remains your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods. We cannot be held responsible for returns that are lost in transit. If you are returning  piece(s) to us for a refund or a replacement, the cost of returning the item to us is your responsibility. Your original postage costs will not be refunded unless the item you received was sent in error or is faulty (providing we are notified of faults within 14 days of receipt).

Please note that your original delivery charges will not be refunded.

For commissioned and/or personalised artwork a return is not possible.

Refunds…

After we have received the returned artwork we will credit your PayPal account with the full purchase price of the artwork returned less credit / debit card charges no later than 30 days from the date of receipt. If you do not return the artwork to us, you are still liable to us for the cost. We are under no obligation to collect or recover the artwork from you, but if we do, our costs will be payable by you.

Cancellations…

You have the right to cancel your order at any time before you receive the artwork you order by contacting Hugo Mumbles via e-mail at care@hugomumbles.com. In the instance that the artwork has already been assigned or despatched when you contact us, you may return the piece(s) within 7 days of receipt of delivery to receive a full refund. Please see our Returns policy.

Use of this Site...

These Terms apply every time you access our Site or use our service. By using this Site you agree to be legally bound by these Terms, and you re-affirm that agreement every time you use our services. If you do not agree to be legally bound by these Terms then please do not use this Site.

Nothing stated or implied in these Terms shall affect the statutory rights of any customer. All other terms and conditions expressed or implied by statue or otherwise are excluded.

You agree to use the Site for lawful purposes only and access the site solely for your own personal use. You must not use any content of the Site for any commercial or illegal purpose. Your use of the Site should in no way infringe, restrict or inhibit the use and enjoyment of this Site by any third party. You agree not to import or transfer to this Site, either directly or indirectly any information or content which is or may be inaccurate, misleading, defamatory, obscene or offensive, in breach of intellectual property right or damaging to the software or performance of this Site. We reserve the right to suspend the Site at any time for operational, regulatory, legal or other reasons. We may terminate your use of the Site with immediate effect if you breach any of these Terms. It is your responsibility to ensure you have the appropriate hardware and software (including virus protection) to enable you to access and use this Site through your computer in a safe and secure manner. We are not responsible for any virus or bug that affects your computer or network as a result of using or downloading information from this Site. Whilst Hugo Mumbles take all reasonable measures to ensure a fast and reliable service, it does not guarantee that your use of this Site will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Site Content and Product Information...

We aim to ensure that all the information available on our site at any time is accurate and complete. This includes artwork descriptions, specifications, colour, pricing and delivery charges. However, due to the original and unique nature of each art piece, specifications and descriptions on this site are not intended to be binding and are intended only to give a general description. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by software or computer system used by you. The colours and appearance of artwork displayed on our site may vary slightly from the original products. This is due to differences in individual monitor settings, photography limitations and file size restrictions.

At any given time information posted on our website may be subject to inaccuracy or may be out of date. However, we are not responsible for any errors or omissions. If you notice an error or omission on our site please point it out to us. We will then use all reasonable endeavours to correct errors and omissions as quickly as possible. All content provided on the site is subject to change without prior notice.

Please note, whilst every effort is made to maintain the accuracy of our information on available stock, on occasion discrepancies may occur and artwork advertised may not be available. Should you place an order for an item displayed as available on our website, and in fact this item is out of stock, we will notify you as soon as possible.

Hugo Mumbles intends to use its content to enhance and improve the browsing and purchasing experience on its website. In no way is the content used on our site intended to offend any of our visitors and/or customers. Any links we may provide to other websites are chosen exceptionally carefully to ensure the linked sites are appropriate and in line with our code for undertaking commercial activity. We will not however be responsible nor liable for your use of any other website which may access via links within our site. Hugo Mumbles does not control these sites and is not responsible for their content.

No statement on this website shall be deemed to affect your statutory rights.

The information we collect about you will primarily be used by us to provide our service or respond to an enquiry, and secondly to inform you of news, events and other information about our service. If at any time you do not wish to receive this marketing information, you can unsubscribe by replying to a promotional email with the word "unsubscribe" in the subject line or by e-mailing us at info@hugomumbles.com. You may review the information we hold about you by sending an email to info@hugomumbles.com. If you find any inaccuracies, we will delete or correct it promptly.

Limitation of Liability...

We are not liable in any circumstances for special, indirect or consequential loss or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with your use of our Site or the purchase of artwork. In any claim against us our liability is limited to the value of the artwork you have purchased in the contract which is the subject of the dispute.

We have taken all reasonable care to ensure the information contained within this Site is accurate, current and complies with relevant legislation and regulations as at the date of issue. However, we accept no liability for any losses or damages arising from any errors or omissions or for this information becoming out of date. Access to and use of our Site is at the user's own risk. We do not guarantee that the use of this Site will be compatible with your PC. We accept no liability for any computer virus infection, corruption or loss of data held on your PC, or any liability for any other losses or damages of any kind resulting from the use of this site or from any material downloaded from it.

We do not warranty that our site or server shall be available on an uninterrupted basis, and consequently we accept no liability for any losses or damages arising out of such unavailability. We accept no liability for any losses or damages arising out of changes made to the content of this site by unauthorised third parties.

We shall not be liable for any failure to perform our obligations under these Terms if caused by matters beyond our reasonable control.

Indemnity...

You agree to keep us indemnified against all actions, claims, costs, expenses (including all legal costs) and damages brought against or suffered by us arising out of any breach of these Terms or any activity relating to your use of this Site (including negligent or wrongful conduct) by you or any other person accessing this Site using your name or any other name with which you have registered under this Site.

Communications...

Any electronic communication sent by e-mail or otherwise will be deemed to have been sent once it enters an information system outside the control of the originator of the message; and will be deemed to have been received by the intended recipient at the time that in a readable form it enters an information system which is capable of access by the intended recipient; and will be deemed to have been despatched in the case of a business at its principal place of business and in the case of an individual where he or she ordinarily resides; and will be deemed to have been received in the case of a business at its principal place of business and in the case of an individual where he or she ordinarily resides.

Any communication sent by post will be deemed received by the intended recipient three days following mailing where sent by first class post or five days after mailing where sent by second class post.

General Information...

The Terms outlined above constitute the entire agreement between you and us where you are a visitor, prospective buyer or buyer to the site. Any failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Furthermore no waiver by us, in exercising any right, power or provision shall operate as a waiver of any other right or of that same right at a future time. These Terms and the relationship between you and us shall be governed by the laws of England. We reserve the right to vary the Terms from time to time and without notice, with such variations becoming effective immediately upon posting to the Site. By continuing to use the Site you will be deemed to accept any such variations.

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Where we provide artwork without specific charge, then it is deemed to be provided free of charge, and not to be associated with any other service for which a charge is made. Accordingly, there is no contractual nor other obligation upon us in respect of any such goods. Nothing in this agreement or on our Site shall confer on any third party any benefit under the provisions of the Contracts (Rights of Third Parties) Act 1999.
